Functions:

  • To advise the Minister and the leaders and officials of the Ministry of Culture, in matters of a legal nature, related to the activities carried out by the office.
  • To comply with and monitor compliance with the legal regulations, in the office system.
  • To make consultations and issue opinions on the legality of documents, claims, complaints and appeals submitted for their consideration, related to the activities carried out by the organization.
  • To study the regulations, projects and legal documents and to inform at a higher level about their implications for the body, its cultural institutions, centres and other departments, and to propose, where appropriate, the measures it considers appropriate.
  • To contribute to the fact that regulations, resolutions, instructions and other documents of a normative nature are issued within the limits of the respective competences and that socialist legality is observed in this.
  • To give its opinion on draft laws, decree-laws, decrees, regulations and other legal provisions submitted for consideration by the office;
  • To prepare draft laws, decree-laws, decrees, regulations and other legal provisions of interest for the better development of the activities of the organization, its cultural institutions, centers and other departments.
  • To register, preserve and, if necessary, process the legal documents drawn up by the organization, as well as to issue the required certifications.
  • Legalize the signatures of the main leaders and officials in order to be accredited in its relations with other national entities, and process them through the Ministry of Foreign Affairs, when required, depending on the relations with other countries or international entities;
  • Participate in negotiations for the signing of intergovernmental agreements and conventions, in which the Cuban party is represented by the Ministry of Culture, as well as in trade negotiations, which, due to their importance for the country, are directly handled by the office;
  • Attend to consultations, advise and assist in the drafting and preparation of conventions, agreements and other documents deriving from international trade relations, both at government level and with commercial entities directly;
  • Act as legal representative of the organization before other national or foreign entities;
  • Acting on behalf of the Ministry of Culture, or any of its cultural institutions, when so decided, in criminal, civil, administrative, labor, economic and national and international arbitration proceedings where appropriate, or their leaders, when dealing with matters relating to the functions of their respective positions;
  • Propose measures to contribute to the development of legal awareness and culture among the staff of the agency's system;
  • To draw up or give an opinion on contracts and pro formas of contracts, in cases where the Ministry of Culture is a party;
  • Participate in working groups, events and others of a similar nature sponsored by international organizations and agencies, linked to legal matters related to culture;
  • Representing the Ministry of Culture before commissions and participating in working groups that, due to the nature of the matter, are within the competence of the Ministry;
  • To study and give an opinion, from the legal point of view, on the operations to be submitted to the Contracting Committee;
  • Promote, systematize and keep updated the legal provisions, national or foreign, related to the system of the organization or to the activity under its responsibility, including the texts of treaties, conventions, protocols and other documents that imply obligations or rights of the organization, as well as keep updated, in the subject of their specialty, the jurists of the entities of the system of the organization;
  • To advise the minister and the authorized leaders on the application of disciplinary corrective measures to leaders, officials and workers;
  • Systematically analyze the legal norms in force, related to the activity carried out by the Ministry of Culture, proposing to the corresponding higher management level, the modifications that they consider appropriate;
  • To provide legal advice to lawyers and organizational units of the institutions, companies and entities attached to the Ministry, guiding the work of legal advisors methodologically, assisting them in any branch of law; contributing to administrative efficiency and contractual discipline on which business management is based and maintaining supervision and control of the work of its legal advisors.
